It is published in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates the publication of the Privacy Policy and Terms of Use for accessing or using the website www.onmissionfoundation.org

Ø The purpose of these Terms and Conditions, along with any referenced policies or documents, is to govern the manner in which individuals can access and use the platform (referred to as T&Cs). By using the platform, it is necessary for you to read, understand, and express your consent to these T&Cs. If you do not wish to provide consent, you should refrain from using the platform in any manner. Upon your consent, these T&Cs form a legally binding contract between you and On Mission Foundation.

Ø The term "User" or "You" in these Terms and Conditions refers to different individuals or entities who are involved in various aspects of the platform. This includes

Donors: Individuals or entities who provide contributions as defined below.

Campaigners: Individuals or entities who initiate and manage online giving campaigns.

Recipients: Individual(s), hospitals, or charitable organizations who receive the benefits from the online giving campaigns.

Body Corporates: Companies or organizations that utilize corporate social responsibility services through the OMF Platform.

Visitors: Individuals who browse the platform without actively participating in any specific actions.

Ø We retain the right to revise the Terms and Conditions and will provide notice to the User regarding any changes made. If the User continues to use the Platform following any amendments, it will indicate their acceptance of the updated Terms and Conditions. However, if you do not agree to the modifications, please contact us at support@onmissionfoundation.org

Ø The Platform facilitates the running of campaigns or fundraising events by specific Users, including individuals and organizations known as Campaigners. These campaigns aim to raise funds for various activities, which include:

Causes: Activities focused on poverty alleviation, providing relief to the poor, promoting education, healthcare and medical relief, and preserving the environment. These objectives are collectively referred to as "Causes”.

Other online giving programs and activities:  In addition to Causes, the Platform supports various other online giving programs and activities.

Corporate social responsibility:  The Platform also provides services related to corporate social responsibility, such as grant making, project management, and other related activities.

Ø Campaigners on the Platform engage in fundraising by soliciting donations from both domestic and international donors (referred to as Donors) for their various programs, projects, and listed causes (referred to as Donations). The Platform serves as a listing and hosting platform, acting as an intermediary that facilitates the connection between Campaigners and their desired Donors, enabling the process of making and receiving donations.

Ø It is important to clarify that we do not function as brokers, agents, financial institutions, creditors, or insurers for any fundraising activities on the Platform. Our role is limited to providing a platform and enabling the services outlined in these Terms and Conditions.

Ø On Mission Foundation grants the User a limited, non-exclusive, non-transferable, non-assignable, and revocable-at-will license, without the right to grant sublicenses. This license allows the User to access and utilize the Platform for the purpose of making, receiving, and raising Donations. Additionally, it permits the User to avail themselves of any other services offered now or in the future, in accordance with the terms stated in these Terms and Conditions.

Ø The collection and distribution of Donations for Campaigns on the Platform will be carried out according to the specified process, with processing fees and/or tips deducted in accordance with the terms mentioned in these Terms and Conditions

Ø For INR Donations made on the Platform in India, excluding those designated for healthcare and medical relief purposes, On Mission Foundation (OMF) will collect these donations and subsequently disburse them to the designated causes and the respective User(s).

Ø OMF is responsible for collecting and processing INR contributions made on the Platform in India for campaigns with objectives other than causes. Once collected, OMF will disburse these donations to the respective User(s) or beneficiaries. It is important to note that Donations will be collected by OMF and then disbursed accordingly.

Ø OMF will make every effort to ensure timely disbursement of the Donations. However, if there are any delays due to circumstances beyond our reasonable control, On Mission Foundation will not be held liable.

Ø Once a disbursement is initiated, communication will be sent via email, and a disbursement report containing the details of the Donors will be provided to the User.

Ø We also provide assistance to companies and organizations in planning, initiating, and managing their corporate social responsibility (CSR) activities in accordance with Schedule VII of the Companies Act, 2013. This includes offering project management services to support their CSR initiatives.

Ø Furthermore, we offer regulatory support to ensure that companies and organizations comply with the rules and regulations related to CSR. We stay updated on any amendments or updates in the CSR framework and address queries from stakeholders, keeping them informed of any developments.

Ø To access these CSR services, companies and organizations are required to enter into separate service arrangements or contracts with us. These agreements will outline the scope of work and associated terms. However, it is important to note that even with separate agreements in place, the company or organization will still be subject to the Terms and Conditions and privacy policy of the Platform in relation to their activities on the Platform, unless explicitly agreed otherwise between the parties involved.

Ø Donations made on the Platform are subject to a standard payment processing charge of 18%. This charge, which is deducted from the Donations before disbursement, goes to the account of the recipient(s). Any changes to this processing charge will be notified accordingly. Please note that these charges are non-refundable.

Ø In addition to the standard processing fee, the Platform may also charge promotional fees of 15% or another specified amount for fundraisers that are promoted through online channels to acquire Donors. In such cases, we reserve the right to require you to agree to additional terms if necessary for these fundraisers.

Ø Donors have the option to provide tips along with their Donations. These tips will be retained entirely by OMF or the relevant entity.

Ø We have the sole discretion to introduce new services and modify existing services offered on the Platform. In such instances, OMF reserves the right to introduce fees for the new services or amend fees for the existing services.

Ø On Mission Foundation, along with any collaborating entity, shall not be held responsible or assume liability for any loss or damage that may directly or indirectly occur while availing any payment methods. This includes situations such as lack of authorization for transactions, declined payments, pre-set limits with banks, and other related circumstances.

Ø While payment transactions are processed by third-party payment gateways or banks, they have access to and process your personal information. Any such processing is solely their responsibility, and On Mission Foundation will not be liable for any breaches, harm, or unauthorized use of personal information by these payment gateways or banks.

Ø User Eligibility:

For Individuals:

In order to use the Platform, you must be at least 18 years of age and have the legal capacity to enter into a contract as per the Indian Contract Act, 1872. By accessing or using the Platform, you confirm and represent that you are legally capable of entering into a contract or have obtained the necessary consent from your parent or guardian.

For Charitable Organizations and Legal Entities:

If you are registering on behalf of a charitable organization or any other legal entity, not being an individual, you must have the proper authorization from the organization to accept these Terms and Conditions. You also affirm that you have the authority to bind the organization to these Terms and Conditions.
